Careless Driving with a Fine
A Careless Driving charge with a fine penalty printed on it will carry 6 demerit points and minimum fine amount of $400. When receiving these tickets you have three options:
1. You can plead guilty to the charge
2. You can plead guilty to the charge with an explanation
3. You can plead not guilty and fight the Careless Driving charge laid against you
Careless Driving without a Fine
By simply paying a Careless Driving ticket then you are automatically pleading guilty. You will also receive 6 demerit points on your record and a likely increase in your insurance rates. By pleading guilty with an explanation then the Careless Driving charge will not be taken off your record. In the best case scenario the careless driving ticket may be reduced by the prosecutor, however, this usually only includes the fine amount and not the demerit points.
Careless Driving tickets that do not have a fine amount attached to them require you to automatically go to court. They are a summons to court that requires you to explain your actions. You do not have the option of pleading guilty or simply paying a fine. If convicted, you could face fines of up to $1000.00, imprisonment of up to 6 months and a driver’s license suspension of up to two years.
Pleading guilty to a Careless Driving charge without a fine will more then likely increase your insurance rates substantially. You can expect to pay thousands of dollars extra each year and may even be placed into what is known as the “high risk bracket” for auto insurance companies. In some cases, auto insurance companies will refuse to insure you. This can also be the case where no other previous charges exist or otherwise where your driving record is completely clean.
